By accessing or using SafeNight's website, interactive demo, or platform (collectively, the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
SafeNight is a venue safety platform designed to help bars, nightclubs, and hospitality venues manage incident documentation, capacity tracking, staff coordination, and compliance reporting. SafeNight integrates with select POS systems (currently Toast, Square, and Clover) via secure OAuth connections.
SafeNight is currently in pre-launch. The interactive demo on our website uses simulated venue data for demonstration purposes only.
You must be at least 18 years of age and have the legal authority to enter into this agreement on behalf of yourself or the venue you represent.

SafeNight accesses POS data via read-only OAuth connections. By authorizing a POS integration, you confirm that you have the authority to grant SafeNight access to that POS account's data (orders, staff, zones, and floor plan information). SafeNight does not modify, write to, or interfere with your POS system.
Your venue data remains yours. SafeNight processes POS and incident data to provide the Service. We do not sell your data to third parties. You may request a full export of your data at any time by contacting support@safenightvenue.com.
SafeNight provides tools for incident documentation and compliance reporting. These tools are designed to support — not replace — your venue's legal, regulatory, and insurance obligations. SafeNight does not provide legal advice. You are responsible for ensuring your venue meets all applicable local, state, and federal regulations.
Paid subscriptions are billed monthly or as a one-time fee, depending on the plan selected. All fees are non-refundable except as required by law. We reserve the right to adjust pricing with 30 days' written notice.
You may cancel your monthly subscription at any time. Cancellation takes effect at the end of the current billing period. Upon cancellation, you retain access to your data export for 30 days.
To the maximum extent permitted by law, SafeNight and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid to SafeNight in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. SafeNight does not guarantee that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. SafeNight is not a substitute for legal counsel, insurance advice, or regulatory compliance guidance.
You agree to indemnify and hold harmless SafeNight, its co-founders (Eric Moore and Chris Canavan), and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
All content, features, and functionality of the SafeNight platform — including but not limited to software, design, text, logos, and branding — are the property of SafeNight and are protected by applicable intellectual property laws.
We may update these Terms from time to time. We will notify active subscribers of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Iowa, United States. Any disputes shall be resolved in the courts of Polk County, Iowa.
